Terms of use

The trading terms that govern partner accounts and orders placed on partner.airfresh24.com.

These terms are being finalised. The summary below describes how the portal actually operates today and is offered in good faith, but it is not yet Elix’s complete business-to-business terms and conditions. Until the full document is published, the binding terms of any individual sale are those stated in the order confirmation Elix sends you. If a point below matters to a decision you are making, please ask us before you order.

1. Who this portal is for

partner.airfresh24.com is a wholesale portal operated by MB EliX sp. z o.o. sp.k. (“Elix”) for businesses buying Elix products for resale, distribution or professional use. It is not a consumer shop. Accounts are granted to businesses only, and consumer distance-selling rights — including the statutory 14-day right of withdrawal — do not apply to purchases made here.

2. Accounts and approval

Registration is an application, not an account. Elix reviews each application by hand and may approve or decline it at its discretion, and may ask for further information about the business before deciding. The catalogue, prices and ordering tools become visible only once an account is approved. You are responsible for keeping your login credentials confidential and for orders placed through your account.

Elix may suspend or close an account that is used outside these terms, or where the business details given at registration turn out to be inaccurate.

3. Prices

All prices on this portal are net, in euro (EUR), per piece, and exclude VAT and delivery costs. The price shown against a product is your account’s price: the Elix catalogue price with the discount group assigned to your account already applied.

Where a recommended retail price (RRP) is shown, it is indicative reference data provided as a convenience. It is a suggestion and never a condition of sale — you set your own resale prices.

Elix may change catalogue prices and discount groups. The price that applies to an order is the one displayed at the moment the order is placed.

4. Ordering in whole cartons

Products are sold by the carton. Each product has a fixed number of pieces per carton, shown on its product page, and quantities must be a whole multiple of it — the portal will not accept a part carton at any point between the product page and the checkout.

A minimum order value applies to each order; the current figure is shown in your cart and on the bulk order page as you build the order.

An order placed through the portal is an offer to buy. A contract is formed when Elix confirms the order. Elix may decline an order, or confirm it in part, where stock, a production run or a credit check requires it.

5. VAT and invoicing

Elix is registered in Poland under NIP PL9151737625. Orders to businesses in other EU member states that supply a valid EU VAT number, validated at registration, are invoiced without Polish VAT as intra-community supplies; accounting for VAT in the destination country is then your responsibility. Orders within Poland, and orders where no valid EU VAT number has been supplied, are invoiced with Polish VAT at the applicable rate.

6. Delivery and origin

Goods are dispatched from Wrocław, Poland, as whole cartons, palletised where the order size calls for it. Delivery terms, carrier and costs are agreed per order and confirmed in the order confirmation.

Elix products are manufactured in Poland and can be supplied with an EUR1 certificate of origin where the destination requires one for preferential customs treatment. Ask for it when you place the order.

7. Product information

Logistics data on the portal — pieces per carton, cartons and pieces per pallet, EAN codes, weights and dimensions — is maintained from Elix’s own production data and is intended to be accurate. Fragrance ranges and pack designs may be changed or discontinued. Photographs are illustrative.

8. Complaints

Report shortages or transport damage on delivery, and quality complaints as soon as they are found, quoting the order number and the SKU. Write to info@airfresh24.com. Elix will agree a remedy — replacement, credit or refund — case by case.

9. Personal data

Personal data collected through the portal is handled as described in the privacy policy.

10. Governing law

These terms and any contract formed under them are governed by Polish law. Where the parties cannot settle a dispute between themselves, it is to be heard by the court having jurisdiction over Elix’s registered office in Wrocław.
